<p><strong></strong><a href="http://www.bhamwiire.com/wp-content/uploads/2012/05/Cash-money.jpg"><img class="alignleft size-medium wp-image-1650" title="Offers to Purchase in a Bidding War" src="http://www.bhamwiire.com/wp-content/uploads/2012/05/Cash-money-300x237.jpg" alt="" width="300" height="237" /></a>That&#8217;s the title of an article that I read yesterday on <a title="Biddin Wars" href="http://realtormag.realtor.org/daily-news/2012/04/30/bidding-wars-catch-buyers-guard" target="_blank">Realtor Magazine online</a>. <strong>  </strong>Immediately I thought surely their real estate agents have been sending this message with tremendous emphasis.   The fact is that it should not be any surprise and in my opinion<strong> &#8221;caught off guard&#8221;</strong>does not accurately describe what&#8217;s happening.</p>
<p>Speaking from personal experience, I have been warning buyers that they better <a title="Buying Real Estate in Birmingham Alabama" href="http://www.bhamwiire.com/birmingham-real-estate-investors-better-bring-your-a-game/" target="_blank">come with their A-Game for months now</a>.  And I know many of my fellow agents have been doing the same thing (warning about bidding wars)  for even longer than I have.</p>
<p>The article made me wonder where they got their information from.  I feel almost certain that the vast majority of us have been doing our job and warning buyers that the real estate landscape was changing (as it was changing).</p>
<p>This is just my take, but I think the caption or the title of the article should have been &#8220;Buyers Are Now Starting to Believe What Their Agents Have Been Telling Them All Along:  <strong>There is a Bidding War Going On.</strong></p>
<h3>Time to Step Up to the Plate</h3>
<p>With the caliber of the inventory being less than stellar, buyers must realize that when they find that gem or diamond <a href="http://www.bhamwiire.com/wp-content/uploads/2012/05/Step-up-to-the-plate.jpg"><img class="alignleft  wp-image-1651" title="Buying a home in birmingham alabama" src="http://www.bhamwiire.com/wp-content/uploads/2012/05/Step-up-to-the-plate-237x300.jpg" alt="" width="170" height="216" /></a>in the rough, they best come with the best that they have to offer.  Because just as sure as they fall in love with a property, there will be others falling in love with it almost simultaneously.</p>
<p>Monkey around if you will, you&#8217;ll find yourself making offers for the sake of making offers and in the end, settling for less than your heart&#8217;s desire all because&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;..well I&#8217;ll let you finish that sentence.</p>
<p>Here&#8217;s my advice to buyers,<a title="Search for homes on Bham WIiRE website" href="http://www.bhamwiire.com/home-search/" target="_blank"> when you happen upon that house that has all of the makings of home</a>, it&#8217;s no time to play games and play like the savvy negotiator.  Have your Realtor® or real estate agent review comps with you to see what homes have been selling for in the area and then make your offer accordingly.  If you don&#8217;t make your offer based on the available data, then you can probably kiss that home goodbye and try to become friends with the new owners so you&#8217;ll at least have a chance to visit the home that you lost to them.</p>

<p><strong>Will the Owner Consider a Lease With an Option to Purchase?</strong></p>
<p><img class="alignleft size-medium wp-image-1547" style="border-image: initial; border-width: 1px; border-color: black; border-style: solid; margin: 10px;" title="Lease with option to purchase" src="http://www.bhamwiire.com/wp-content/uploads/2012/03/Lease-with-option-to-purchase-300x285.jpg" alt="" width="300" height="285" />This question pops up every now and then.  The single most misunderstood factor with regard to a lease with an option to purchase revolves around the following terms:  security deposit, down payment and lease option payment.  Usually after addressing this concern, the lease with option is no longer a part of the conversation.</p>
<p>When someone inquires about a lease with an option to purchase, the first question to address is  &#8221;how much of an option payment are you working with?&#8221;  This question is usually followed by a discussion of what constitutes a lease with an option to purchase and the conditions that are usually involved.  In Alabama, the option payment is usually more significant than a security deposit and oftentimes a security deposit is required in addition to the option payment.</p>
<p><em>The option payment ensures that the seller will not sell the home to anyone esle as long as the lease option buyer has the option to purchase and has not violated the terms of the the lease option agreement.</em></p>
<p>&nbsp;</p>
<p><strong>The Lease and The Option Agreements</strong></p>
<p>In Alabama, the lease and the lease with an option to purchase are usually two entirely separate documents.  The second question that I get (after will the owner consider a lease with an option to purchase) is how much is the down payment? When working with a lease with an option to payment, there is no down payment.  Instead there is an option payment which goes directly to the seller and does not have to be held in escrow and is non-refundable.  In a true lease with option to purchase, the option payment is not applied to any future purchase as a down payment.  Inquirers are usually outraged by this fact, as they have been misinformed or have been long time believers of urban legends regarding how lease options work.  Down payments are associated with lease purchases.  NOT lease with options to purchase.</p>
<p>If all you have to work with is a security deposit, then you&#8217;re not a likely candidate for a lease with an option to purchase.  But if you&#8217;d like to know more, please give me a call.</p>

<h3>Don&#8217;t Half-Step</h3>

<p>The title of this post speaks for itself.  There really is no further explanation needed so this post is going to be quite brief.</p>
<h3>Birmingham-Hoover Home Sellers</h3>
<p>There isn&#8217;t much you can do about location if you are planning to sell your house .  Hopefully it&#8217;s in a prime location.  But <a href="http://www.bhamwiire.com/wp-content/uploads/2012/02/Sold.jpg"><img class="alignright size-medium wp-image-1309" title="Sold" src="http://www.bhamwiire.com/wp-content/uploads/2012/02/Sold-300x293.jpg" alt="" width="300" height="293" /></a>even if it&#8217;s not in a prime location, if you really want to get that house sold and not play games, then you need to price it right for the location and make sure it&#8217;s in its utmost show ready mode at all times.  Andif it&#8217;s an investment property, at the very least, you&#8217;ll want to make sure that it isn&#8217;t trashed.  Here&#8217;s a little secret, if you hire an agent that is willing to list your house for sale for more than the available data supports (a.k.a. overprice it) then don&#8217;t count on that agent doing their best to try to sell your overpriced home.  Yes,I know this sounds awfully harsh, but I&#8217;m afraid it&#8217;s the true.  Personally, I&#8217;d much rather walk away from a listing than to overprice it.</p>

<p>Occasionally I get calls from prospective buyers that are working on their credit.  They say that they are paying off debt so they can purchase a home.  So I ask and who advised that you needed to pay off your credit cards?  With one couple in particular, I asked this question and as it turned out, no one had advised them.  And in their case, they had qualified for a mortgage loan the year before, but since they paid off and closed all of their credit cards their credit scores dropped because they had no recent credit history.  Furthermore, they qualified for much less than they did the year before.</p>
<p>Totally paying off creditors is a noble move, but when preparing to purchase home, it can be the death of your pre-approval, and ultimate approval  if you don&#8217;t continue to use your revolving lines of credit.</p>
